1. Acceptance of Terms

By accessing the DupeUGC site, including the Studio, prompt generator, or waitlist form, you agree to these Terms of Service. If you do not agree, please do not use the service.

2. What We Provide

DupeUGC is a browser-based studio that helps you generate prompts and images using third-party AI models. Generated images are delivered to your browser for download, and recent history is stored locally on your device. The service is provided "as is" and may change or be discontinued at any time.

3. Eligibility and Access

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the service. Access may be limited, rate-limited, or waitlisted. You are responsible for ensuring your device and connection are secure when you upload reference images or copy outputs.

4. Content and License

You retain ownership of the prompts and images you provide. By submitting content, you grant us a limited license to process that content solely to operate, improve, and secure the service. You are responsible for ensuring you have the rights and permissions to submit any reference images or prompts.

Because the studio relies on AI models, outputs may be unexpected or inaccurate. Do not upload sensitive, confidential, or unlawful content.

5. Payments and Credits

DupeUGC offers both free and paid tiers. Paid features include monthly subscriptions and one-time credit pack purchases. Pricing is displayed at the point of purchase and may change at any time. Subscriptions renew automatically until canceled.

Credits are used to generate prompts and images. Credits from different sources (free, subscription, purchased) are consumed in a specific order. Subscription credits reset monthly; purchased credits do not expire. All credits have no cash value, are non-transferable, and cannot be refunded except as required by law. We reserve the right to modify credit costs, expiration policies, or revoke credits in cases of abuse or fraud.

6. Acceptable Use

You agree not to use DupeUGC to:

  • Upload, process, or generate illegal content of any kind
  • Process images you do not own or have rights to use
  • Create content that infringes on third-party copyrights or trademarks
  • Generate harmful, abusive, or inappropriate content
  • Attempt to reverse engineer or exploit the service

7. Third-Party Services

DupeUGC relies on third-party providers (including AI model providers, hosting, analytics, and storage services). Your prompts, reference images, and usage data may be transmitted to these providers to operate the service. You agree to their use of your data as necessary to deliver the functionality. We are not responsible for outages or changes introduced by third-party services.

8. Service Changes and Availability

The studio is experimental and may be rate-limited, modified, or temporarily unavailable. We may update the service or these Terms at any time. Continued use after changes become effective constitutes acceptance of the updated Terms.

9. Privacy

Your use of DupeUGC is also governed by our Privacy Policy. By using the service, you agree to the collection and use of information as described therein.

10. Storage and Backups

Generated images and prompt history are primarily stored locally in your browser. We do not guarantee backups or long-term storage. If you clear your browser data or change devices, your history may be lost. Please download and preserve anything you need to keep.

11. Disclaimers and Limitation of Liability

DupeUGC and NFTStoryLTD shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to loss of data, loss of profits, or service interruptions. To the fullest extent permitted by law, our total liability for any claims related to the service will not exceed the greater of (a) the amount you paid for the service in the three months preceding the claim or (b) one hundred U.S. dollars (US$100).

12. Indemnification

You agree to indemnify and hold harmless NFTStoryLTD and its affiliates from and against any claims, losses, or liabilities arising from your misuse of the service or violation of these terms.

13. Governing Law

These terms are governed by the laws of Canada, without regard to conflict-of-law rules. Any disputes will be resolved in the courts located in British Columbia, Canada, unless otherwise required by applicable law.
